Terms of Service

1. About Course Commons

Course Commons is an online discovery and listing platform that connects families with independent educators, instructors, and event organizers (“Educators”). We provide tools for Educators to list courses, classes, and events, and for parents, guardians, and students to discover those offerings.

Course Commons is not an educational institution. We do not create, deliver, supervise, schedule, or control any course, class, event, or educational content listed on this Platform. All offerings are independently organized and operated by third-party Educators who are not employed by or affiliated with Course Commons.


2. Acceptance of Terms

By accessing or using Course Commons (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.

These Terms apply to all users, including parents, guardians, Educators, students, and visitors.


3. User Accounts

3.1 Account types. The Platform supports three account types:

  • Parent / Guardian: For adults who discover courses and manage enrollments on behalf of children in their care.
  • Educator: For independent instructors and event organizers who list courses and events.
  • Student: Accounts created and managed by a parent or guardian on behalf of a learner.

3.2 Eligibility. Educator and parent/guardian accounts require the account holder to be at least 18 years old. Student accounts may be created by a parent or guardian for a learner of any age.

3.3 Accurate information. You agree to provide truthful, current, and complete information when creating or updating your account. Course Commons may suspend or terminate accounts containing false or misleading information.

3.4 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at hello@coursecommons.com if you suspect unauthorized access.


4. Educators and Listings

4.1 Independent contractors. Educators who list on Course Commons are independent third parties, not employees, agents, or representatives of Course Commons. We are not responsible for and do not control the content, quality, safety, accuracy, legality, or delivery of any course, class, or event.

4.2 Educator responsibilities. By listing a course or event, Educators agree to:

  • Provide accurate, truthful, and complete descriptions of all offerings.
  • Comply with all applicable laws, regulations, and licensing requirements in their jurisdiction.
  • Obtain any permits, background checks, certifications, or insurance required by applicable law.
  • Take sole responsibility for the content, delivery, conduct, and safety of their offerings.
  • Handle all direct communications, payments, and disputes with enrolled families.

4.3 No endorsement. Course Commons does not verify, endorse, or guarantee the qualifications, credentials, background, or suitability of any Educator or the accuracy or appropriateness of any listing. Parents and guardians are strongly encouraged to independently research Educators before enrolling a child.


5. Parents, Guardians, and Enrollment

The relationship for enrollment, payment, and participation in any course or event is directly between the parent or guardian and the Educator. Course Commons is not a party to that relationship and assumes no responsibility for:

  • The Educator's conduct before, during, or after a course or event.
  • The suitability of any offering for a particular child.
  • Any accident, injury, or loss occurring during or in connection with a course or event.
  • Any dispute between a family and an Educator regarding enrollment, payment, refunds, or course content.

Parents and guardians bear sole responsibility for evaluating courses and Educators, supervising their child's participation, and communicating directly with Educators about their child's specific needs.


6. Children's Privacy and COPPA

Course Commons complies with the Children's Online Privacy Protection Act (“COPPA”). Student accounts are created by a parent or guardian, who provides consent for any personal information associated with a student. We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent.

7. Prohibited Conduct

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent course or event listings.
  • Collect or harvest personal information from other users.
  • Harass, abuse, threaten, or intimidate any other user.
  • Violate any applicable law or regulation.
  • Infringe upon the intellectual property rights of any person or entity.
  • Impersonate any person, entity, or organization.
  • Transmit spam, unsolicited commercial messages, or malicious code.
  • Circumvent or interfere with the security or integrity of the Platform.

8. Intellectual Property

The Course Commons name, logo, platform design, and original content we create are our intellectual property. You may not copy, reproduce, distribute, or create derivative works from our materials without prior written permission.

Educators retain ownership of the course and event content they create. By listing content on the Platform, Educators grant Course Commons a limited, non-exclusive, royalty-free license to display that content in connection with operating the Platform.


9. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) any course or event listing is accurate, complete, or current; (c) any Educator is qualified, credentialed, or suitable for your child.


10. Limitation of Liability

To the maximum extent permitted by applicable law, Course Commons and its officers, directors, employees, and agents shall not be liable for:

(a) any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform;

(b) any harm, injury, or loss arising from participation in any course or event listed on the Platform;

(c) any content created or actions taken by Educators or other third parties;

(d) the qualifications, conduct, or compliance of any Educator.

Our total liability for any claim arising from your use of the Platform shall not exceed $100 or the amount you paid to us in the twelve (12) months preceding the claim, whichever is greater.


11. Indemnification

You agree to indemnify, defend, and hold harmless Course Commons and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) any content or listings you post; or (d) any harm arising from your participation in or organization of a course or event.


12. Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.


13. Termination

We may suspend or terminate your account and access to the Platform at our sole discretion, with or without cause and with or without notice. Upon termination, your right to use the Platform will immediately cease.


14. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Course Commons operates. Any disputes arising from these Terms or your use of the Platform that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
